This Privacy Policy explains how Food Fleet, Inc., (collectively, "Food Fleet," "we," "us," or "our") collects, uses, discloses, or otherwise processes your personal information and explains how we may use your personal information, your choices and rights you may have depending on the applicable law in your jurisdiction.

This Privacy Policy applies to all personal information that is collected by Food Fleet during any written, electronic, and oral communications online or offline when you:

1.     Personal Information We Collect

Personal information is generally any information that relates to you, identifies you personally, or could be used to identify you. The definition of personal information (used interchangeably with “personal data”) that applies for you in relation to this Privacy Policy depends on the applicable law, which is typically determined based on your state residency or location at the time of data collection. We may collect the following categories of personal information, depending on how you interact with our Services:

Information You Voluntarily Provide to Us. We, or service providers that assist us in providing, maintaining, and operating our Services, may collect the following types of personal information from you:

  • Newsletters Sign Up. You may sign up through our Sites to receive electronic newsletters, marketing and promotional emails from us, including news and updates. To sign up, we may ask you to provide an email address. We may also use this information to tailor our newsletters to reflect your preferences. You can choose at any time not to receive marketing emails from us by clicking on the unsubscribe link within our marketing emails.

  • Partnership Applications. When you apply to join the Fleet – connect your food services with high-profile events and venues that we serve – we may collect information through our online application form so we can evaluate your application, onboard you as a culinary partner, and match you with relevant opportunities. This information may include: your name; your food truck or brand name; your business entity name as it appears on your W-9 (used for payment processing); your business address; business email address and phone number; your website, Instagram username, and menu link; photos of your concept, truck, trailer, signature items, or team that you choose to upload. To process your application, we may also collect supporting business documents such as your business license, seller's permit, health permit, proof of auto insurance, menu with street prices, and W-9 form.

  • Client Service Requests and Event Inquiries. When you contact us to plan an event, recurring food program, consultation, or other food service solution – whether as a new or returning client – we collect information through our online service request forms so we can route your inquiry to the right team, understand your service needs, and plan and deliver your program or event. This information may include: your name, business email address, business phone number, event and venue information, on-site point of contact’s name and contact information, and any records, copies of your correspondence (including email addresses), or additional information you choose to share with us.

  • Feedback or Surveys. We may provide you with the opportunity to participate in surveys or provide feedback about your experience. If you participate, we may request certain personal information from you, typically including contact information (such as name and email address). Participation in these surveys is entirely voluntary. We use this information to improve our services and offerings.

Information We Automatically Collect. To the extent permitted under applicable law, we may automatically collect certain types of data about you when you use or interact with our Services which is considered personal information.

  • Usage Data. When you browse our Sites, we automatically collect data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed, the order of these page views, the date and time you access our servers, and other diagnostic data.

  • Device Information. When you use your desktop or mobile devices to access our Services, we may be able to identify your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.

  • Location Information. When you use our Services, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. You may choose not to share your location details with us by adjusting your mobile or desktop device’s location services settings.

Information We Collect from Third Parties. From time to time, we may obtain personal information about you from third party sources as required or permitted by law. These sources may include:

  • Social Media. We may offer you the opportunity to engage with our content on or through third-party social networking websites, plug-ins and applications. When you engage with our content on or through third-party social networking websites, plug-ins and applications, you may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture) to deliver the content or as part of the operation of the third-party website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on our Services and on the third-party social networking websites, plug-ins and applications, and to provide you with other products or services you may request. Please note, social media features and widgets may be hosted by a third-party. Your interactions with those features are governed by the privacy policies of the companies that provide them.

  • Third Party Partners. Unless prohibited by applicable law, we may obtain your personal information from marketing partners, analytics providers, and other third-party partners to market to you, including to match custom audiences or create lookalike audiences on social media or other marketing platforms so that we can better understand which of our Services may be of interest to you, market our Services to you, and to provide us information necessary to improve our Services.

2.     How We Use Your Personal Information

We use the personal information we collect for a variety of business purposes, including to: evaluate and process partner applications to join the Fleet; respond to client inquiries, and plan and deliver events and food service programs; provide support and communicate with you; detect fraud and protect our Site and Services; personalize your experience and our marketing; and to understand how our Site is used and measure the effectiveness of our marketing efforts.

We will only use your personal information as described in this Privacy Policy or as disclosed to you prior to such processing taking place.

a.     To Provide Our Services. We will use your personal information to provide information or perform Services that you request, including to process your partner applications, address your inquiries, plan and deliver events and food service programs.

b.     To Provide Service-Related Communications. We will send you administrative-related information to keep you updated about your event and food service program, and generally about the Services. Such communications may include information about Privacy Policy updates, confirmations of your event details, security updates or tips, or other relevant administrative-related information. We process your contact information to send you such communications. Service-related communications are not promotional in nature. You are unable to unsubscribe from such communications; otherwise, you may miss important developments relating to the Services.

c.     To Provide Support or Respond to You. We collect any information that you provide to us when you contact us, whether as Fleet partners or clients. Without your personal information, we cannot respond to you or ensure your continued use and enjoyment of the Services.

d.     To Provide Marketing Communications.  If you have voluntarily provided your email address, phone number or other electronic addresses to us when subscribing to our marketing communications, we may email you about food service programs, services, and promotions that we believe may be of interest to you. When you no longer wish to receive these marketing messages from us, you can opt out at any time by following the instructions contained in each email you receive from us or contacting us via the methods specified in the “How to Contact Us” section below. We may also collect and use your online or mobile identifiers for the purpose of marketing campaigns. Please see Cookies and Other Similar Tracking Technologies section for more information.

e.     For Research and To Develop Our Services. We may process your personal information and derive analytical and statistical data to better understand the way you use and interact with our Services. For instance, analyzing where, on which types of devices, and how our Site is used, how many visitors we receive, and where they click on the Site may help us improve our existing Services and build new Services. f.      To Infer Your Interest and Personalize Your Experience. We may process your information to personalize your experience on the Services by presenting contents tailored to you. We may use such information to enable you to interact with our Services more easily across devices, or to recommend more relevant content to you. For example, when you enable the social sharing functionalities of your social media account(s) by interacting with our content on or through third-party social networking websites, plug-ins and applications, we may use this information to personalize your experience on our Services and on the third-party social networking websites, plug-ins and applications.

g.     To Ensure the Security of the Services. We care about keeping you secure and safe while using our Services. Keeping you safe requires us to process your personal information, such as your device information, activity information, and other relevant information. We use such information to combat spam, malware, malicious activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information. We cannot ensure the security of our Services if we do not process your personal information for security purposes.

h.     To Enforce Compliance with Our Terms, Agreements or Policies. When you access or use our Services, you are bound to our Terms and Agreements. To ensure you comply with them, we process your personal information by actively monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services. Subject to the applicable law, we may also process your personal information to: investigate, prevent or mitigate violations of our internal terms, agreements or policies and enforce our agreements with third parties and business partners.

i.      To Facilitate Corporate Acquisitions, Mergers and Transactions. We may process any information regarding your use of our Services as is necessary in the context of corporate acquisitions, mergers or other corporate transactions.

j.      To Maintain Legal and Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to pay our taxes, to fulfill our business obligations, ensure compliance with employment and recruitment laws or as necessary to manage risk as required under applicable law. Without processing your personal information for such purposes, we cannot perform the Services in accordance with our legal and regulatory requirements.

k.     With Your Consent.  For any other purpose disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the Services or other related services requested, with your permission or upon your direction.

3.     How We Share Your Personal Information

We may disclose your personal information as described below.

a.     Our Corporate Organization. We may disclose some or all of your personal information with our subsidiaries and corporate affiliates, joint ventures, or other companies under common control with us for the purposes described in this Privacy Policy unless otherwise prohibited by applicable law or by contractual agreement with our vendors, service providers or other third parties.

b.     Service Providers. We may disclose your personal information with service providers acting on our behalf to help us operate our Services. Service providers and vendors provide us with support services, such as: managing a database of partner and client information; hosting the Sites; designing and/or operating the Sites’ features; tracking the Sites’ activities and analytics; enabling us to send you administrative or marketing communications; operating our client service inquiries and processing partnership applications. These service providers may have access to or process your personal information only for the purpose of providing services to us.

c.     Maintain Legal and Regulatory Compliance. We may disclose your personal information to law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Food Fleet or third parties (including through the enforcement of this Privacy Policy, our Terms of Use, and other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas, or court orders).

d.     During Business Transfers; Bankruptcy. In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets, any personal information owned or controlled by us may be one of the assets transferred to third parties. We reserve the right, as part of this type of transaction, to transfer or assign personal information and other information we have collected from users of the Services to buyers, service providers, advisors, potential transactional partners or other third parties in connection with the advisors, potential transactional partners or other third parties of a corporate transaction. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Policy. However, any information you submit or that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity.

e.     Third Party Analytics and Interest-based Advertising Partners. 4.     Cookies and Other Similar Tracking Technologies

We and our third-party partners and service providers (such as advertisers and analytics providers) may use cookies and similar digital tracking technologies (such as pixels, web beacons, and tags) (collectively, “Tracking Technologies”) on our Services to gather information when you interact with our Sites and Services. These Tracking Technologies help us operate our Services, understand your usage, improve functionality, and, depending on your choices and where you live, deliver and measure advertising.

Tracking Technologies can be placed on our Services by us or by third-party partners we engage for our purposes. Third-party cookies may also be deployed on our behalf on third-party websites (e.g. to measure the effectiveness of ads).

  • Necessary. These Tracking Technologies are required for the operation of Services. These Tracking Technologies do not gather information about you for marketing purposes.

  • Performance and Analytics. These Tracking Technologies allow us and our analytics service providers/processors to count visits and traffic sources, or test new features, so that we can measure and improve the performance of our Sites and Services, including as part of our analytics practices to improve the content offered. They help us understand how visitors use our Sites and Services, which site or page the user came from, the number of each user’s visits and how long a user stays on the Sites and Services.

  • Advertising. These Tracking Technologies may be set through our Sites by our advertising partners to deliver content, including ads, that are relevant to your interests across your devices, based on how you interact with our advertisements or content. They may be used by our advertising partners to build a profile of your interests and to show you relevant ads on other sites. They do not store directly personal data but are based on uniquely identifying your browser and internet device. If you do not allow these Tracking Technologies, you will experience less targeted advertising.

Why We Use Tracking Technologies.

We may use these Tracking Technologies for the following purposes:

  • Recognizing you when you return to our Sites;

  • Keeping track of your specified preferences;

  • Conducting research and diagnostics to improve content on our Sites;

  • Preventing fraudulent activity and improving security;

Disabling Certain Interest-Based Advertising.

Interest-Based Advertising - Website Browser.  Many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (DAA), which maintains websites where people can opt out of interest-based advertising from their members. To opt out of website interest-based advertising provided by each organization’s respective participating companies, visit the DAA’s opt-out portal available at http://optout.aboutads.info.

5.     Security

To protect your personal information, we use commercially reasonable administrative, technical, and physical safeguards, take reasonable precautions and follow industry standards to help protect and secure your personal information so that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. However, no information system can be 100% secure. As a result, we cannot guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information that you transmit to the Services over networks that we do not control, including the Internet and wireless networks

Please recognize that protecting your personal information is also your responsibility. We ask you to be responsible for safeguarding any authentication information you use to access our Services. If you feel that the security of your personal information has been compromised, please immediately contact us. Please be aware that, despite our best efforts, no security system is impenetrable. In the event of a security breach, we will promptly notify you and the proper authorities if required by law.

6.     Retention

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired. In addition, we retain your email address and information about your marketing preferences to ensure that we can honor those preferences.

If you send us correspondence, including emails, we retain such information electronically in the records of your account. We will also electronically retain partners’ and clients’ correspondence and other correspondence from Food Fleet to you. We retain these records to measure and improve our partners’ and clients’ service and to investigate potential fraud and violations.

We will also retain Site and Services usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Site, or we are legally obligated to retain this data for longer periods. We may also retain de-identified, aggregate Services usage data for internal analysis purposes.

If you wish to request that we no longer use your information to provide you Services, we may still retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

8.     Children

We understand the importance of protecting children’s privacy in the interactive world. Our Services are not intended for individuals under the age of majority in the applicable jurisdictions, which includes for clarification, that our Services are not intended for individuals under the age of 18. Therefore, we do not knowingly process Personal Information from individuals under 18 years old. If you are under 18 years of age, you should not use the Sites and should not send any information about yourself to us through the Sites.

If you are a parent or guardian and you believe that your child has provided us with information without your consent, please contact us at privacy@foodfleet.com, and we will take reasonable steps to ensure that such information is deleted from our databases in accordance with applicable law.

Our Services may contain links to third-party websites and/or applications of our partners or affiliates that are not owned or operated by us (such as the social media pages). This Privacy Policy does not apply to those third-party sites. If you follow a link to any of these websites, we recommend that you read the privacy notice or privacy policy of any third-party website that you visit before you submit any personal information to them. We do not control the privacy practices of these third-party websites and we are not responsible for their information privacy practices.

10.  Additional Notice for California Residents

This section applies only to California residents. Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), below is a summary for the last twelve (12) months of the personal information categories, as defined by California Civil Code section 1798.140 (o), that we collect, the reason we collect the personal information, where we obtain the personal information, and the third parties that we may share the personal information.

We do not sell or share (for cross-context behavioral advertising) the personal information of consumers under 16 years of age.
